Welcome to Lagune the Label (ABN [25219442086]) (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website and the purchase of products from lagunethelabel.com (the “Site”).

By accessing or using the Site, or purchasing from us, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the Australian Consumer Law or any other law that cannot be excluded.

Online store terms

You must be at least 18 years old, or accessing the Site under the supervision of a parent or guardian.

You agree not to use our Site or products for any unlawful or unauthorised purpose and not to violate any laws in your jurisdiction.

We reserve the right to refuse service to anyone for any lawful reason at any time.

Products and availability

We aim to describe our products (including colours, fabrics, sizing and finishes) as accurately as possible. However, colours may appear differently on different screens and minor variations may occur between items.

All products are subject to availability. We may limit quantities, discontinue products or change details at any time.

We reserve the right to refuse or cancel any order if a product is unavailable, mispriced or if we suspect fraud or misuse.

Pricing and currency

All prices are shown in Australian dollars (AUD) and include GST where applicable.

Prices are subject to change without notice. Any changes will not affect orders that have already been accepted.

Shipping fees (if applicable) are added at checkout and displayed before you complete your purchase.

Orders and payment

By placing an order, you offer to purchase a product in accordance with these Terms.

An order is confirmed when payment is successfully processed and you receive an order confirmation email.

We accept payment via the methods shown at checkout (for example, credit/debit card, Shop Pay, PayPal, etc.).

We may cancel or refuse an order (for example, where there is an error in pricing or availability). If payment has already been processed for a cancelled order, we will refund the relevant amount.

Shipping and delivery

Available shipping options, estimated timeframes and fees are shown at checkout and/or on our Shipping page.

Delivery timeframes are estimates only. Delays can occur due to carriers, public holidays, peak periods or other events outside our control.

Risk in the goods passes to you once your order has been dispatched to the address provided. Please ensure your shipping details are correct; we are not responsible for orders lost or delayed due to incorrect or incomplete addresses.

Returns, exchanges and refunds

Our Returns Policy forms part of these Terms. Please refer to that page for full details, including eligibility, timeframes, hygiene requirements and any exclusions.

In summary, subject to our Returns Policy and the Australian Consumer Law:

  • Items must generally be returned in original condition, unworn, unwashed, with tags and hygiene stickers intact.

  • For hygiene reasons, some items (such as swimwear bottoms) may not be eligible for change-of-mind returns unless faulty, in accordance with Australian Consumer Law.

  • If a product is faulty, not as described or does not meet a consumer guarantee, you may be entitled to a repair, replacement or refund under the Australian Consumer Law.

Lost or damaged charms and hardware

Some pieces include delicate charms or hardware (including baroque pearls and gold alloy detailing).

If your charm or hardware becomes lost or damaged, please email hello@lagunethelabel.com with your order details, photos and a brief description of what happened. We will review this on a case-by-case basis and do our best to assist, subject to availability, timing and these Terms. Replacement charms or hardware may incur a fee and additional shipping costs, which will be communicated before confirming any replacement.

To prolong the life of your charms and hardware, please follow the care instructions on the product page and/or garment label.

Sizing, fit and sheerness

Each style may fit differently depending on the fabrication and design. Please refer to our Size Guide and fit notes on each product page.

Certain fabrics are designed to be form-skimming and may appear slightly sheer when stretched or in strong light. Where relevant, we provide information about coverage and may suggest sizing (for example, recommending sizing up for additional opaqueness or coverage).

It is your responsibility to review sizing and fit information before purchasing, but we will always work with you in line with our Returns Policy and the Australian Consumer Law if there is an issue.

Promotions and discount codes

From time to time, we may run promotions or offer discount codes.

Unless stated otherwise:

  • Promotions and discounts are valid for a limited time only.

  • Discounts cannot be used in conjunction with any other offer or on past orders.

  • Discounts are not transferable or redeemable for cash.

We may modify or withdraw promotions at any time, in accordance with applicable law.

User accounts and information

You may create an account to save your details and view order history. You are responsible for maintaining the confidentiality of your login details and for all activity under your account.

You agree to provide current, complete and accurate information and to update your details promptly if they change.

Intellectual property

All content on the Site, including text, graphics, logos, images, product names and designs, is owned by or licensed to Lagune the Label and protected by intellectual property laws.

You must not reproduce, distribute, modify, create derivative works from or otherwise use any content from the Site without our prior written consent, except as permitted by law.

Reviews, social content and submissions

If you submit reviews, comments, photos or other content to us, or tag us on social media, you:

  • represent that you have the right to do so; and

  • grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit and share that content for marketing and promotional purposes (for example, reposting on our Site or social channels), unless you notify us otherwise in writing.

You must not submit content that is unlawful, defamatory, offensive, infringing, misleading or that contains viruses or malicious code. You are solely responsible for any content you submit.

Optional tools and third-party services

Our store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

We may provide access to third-party tools or services (for example, payment gateways, apps or plugins) that we do not control or monitor.

You acknowledge that:

  • such tools are provided “as is” and “as available”; and

  • we are not responsible for, and have no liability arising from, your use of third-party tools or services.

Your use of any third-party tool or service is entirely at your own risk and subject to the terms and conditions of the relevant third-party provider.

From time to time, our Site may contain links to third-party websites. We are not responsible for the content, policies or practices of third-party sites.

Prohibited uses

In addition to other prohibitions set out in these Terms, you must not use the Site or its content:

  • for any unlawful purpose;

  • to solicit others to perform or participate in unlawful acts;

  • to violate any applicable laws or regulations;

  • to infringe our intellectual property rights or the rights of others;

  • to harass, abuse, insult, harm, defame, intimidate or discriminate;

  • to submit false or misleading information;

  • to upload or transmit viruses or malicious code;

  • to collect or track the personal information of others without consent;

  • to spam, phish, scrape or crawl; or

  • to interfere with or circumvent the security features of the Site or related services.

We may suspend or terminate your access to the Site if you breach this clause.

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.

By using the Site or placing an order, you consent to us collecting, using and handling your personal information as described in the Privacy Policy.

Disclaimer of warranties and limitation of liability

To the fullest extent permitted by law, and except as expressly provided in these Terms or required by the Australian Consumer Law:

  • the Site and all products and services are provided “as is” and “as available”; and

  • we make no warranties or representations, express or implied, about the accuracy, completeness, reliability or availability of the Site or any content.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, savings, data or goodwill, arising out of or in connection with your use of the Site or purchase of products.

Where liability under any term, condition or warranty cannot be lawfully excluded, our liability is limited, at our option, to:

  • the replacement of the goods or the supply of equivalent goods;

  • the repair of the goods; or

  • the payment of the cost of replacing or repairing the goods or of acquiring equivalent goods.

Nothing in these Terms excludes any rights or remedies you may have under the Australian Consumer Law.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page. The updated Terms will apply from the date of posting.

Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms.
